The authors of this book start from the idea that the technical regulation of markets is not objective, since any 'technical' decisión reflects an ideological approach and has (positive and/or negative) social consequences. Both international law and European law impose very significant constraints on the legal framework governing markets and limit the sovereign powers of states to regúlate them. This situation has been exacerbated by the measures imposed by the EU to alleviate the economic crisis. They have called in question structural elements of the constitutional framework of the member states and are raising tensions with the fundamental rights of citizens. It seems of the utmost ¡mportance to research various thematic vectors that have allowed us to determine whether there has really been such a general erosión of the European social and political model, and to what extent the international legal framework reinforces this trend: the deterioration of economic and social rights, the instrumentalization of citizens as hostages of credit institutions, a decrease in the ability of individuáis to determine their own destiny in democratic elections, a relaxation of environmental standards to reduce energy dependence or as a consequence of the norms that regúlate international trade, or the marginalization of democratic conditionality and human rights in trade and financial relations with third countries. Ultimately, this book's objective consists of ¡dentifying what is the position of the individual and of its citizenship rights vis-á-v¡s the markets.

Los autores de este libro parten de la idea de que la regulación técnica de los mercados no es objetiva, ya que cualquier decisión «técnica» refleja un enfoque ideológico y tiene consecuencias sociales (positivas y/o negativas). Tanto el derecho internacional como el derecho europeo imponen condicionantes muy significativos en el marco legal que ordena los mercados y limitan las competencias soberanas de los estados para regularlos. Esta situación se ha visto exacerbada por las medidas impuestas por la UE para paliar la crisis económica. Dichas medidas han cuestionado algunos elementos estructurales del marco constitucional de los Estados miembros, generando tensiones con derechos fundamentales de los ciudadanos. Parece de suma importancia investigar varios vectores temáticos que nos han permitido determinar si realmente se ha producido esa erosión general del modelo político y social europeo y, en su caso, en qué medida el marco legal internacional ha reforzado esta tendencia: el deterioro de los derechos económicos y sociales, la instrumentalización de los ciudadanos como rehenes de las instituciones de crédito, una disminución en la capacidad de los individuos para determinar su propio destino en elecciones democráticas, una relajación de los estándares ambientales para reducir la dependencia energética o como consecuencia de las normas que regulan el comercio internacional, o la marginación de la condicionalidad democrática y los derechos humanos en las relaciones comerciales y financieras con terceros países. En última instancia, este libro pretende determinar dónde quedan el individuo, y sus derechos de ciudadanía, frente a los mercados.
